Benvenuto/a in FAIL Streetwear! I termini “noi” e “nostra/e/o/i” si riferiscono a FAIL Streetwear, che gestisce questo negozio e il sito web. Le informazioni, i contenuti, le funzionalità, gli strumenti, i prodotti e i servizi offerti sono finalizzati a garantire un’esperienza d’acquisto adeguata al cliente (di seguito i “Servizi”). Accettando questi Termini dichiari di essere maggiorenne secondo la legislazione vigente nel tuo stato o provincia di residenza. Sei responsabile di tutte le attività svolte tramite il tuo account e della protezione delle tue credenziali. Non è consentito cedere o concedere in licenza il proprio account a terzi.

2. I Nostri Prodotti / Our Products

Ci impegniamo a fornire una presentazione accurata dei prodotti, pur segnalando che i colori possono variare in base al dispositivo utilizzato dal cliente. Tutte le descrizioni dei prodotti possono essere soggette a modifiche senza preavviso e la vendita può essere sospesa o limitata a nostra discrezione.

We strive to provide accurate product descriptions, though colors may vary depending on the customer’s device. All product descriptions may be modified without notice, and sales may be suspended or limited at our discretion.

3. Ordini / Orders

L’invio dell’ordine da parte del cliente costituisce una proposta di acquisto. FAIL Streetwear si riserva il diritto di accettare o rifiutare l’ordine a propria discrezione. L’ordine viene considerato confermato solo dopo l’accettazione da parte nostra. Si invita il cliente a verificare attentamente i dati prima dell’invio. Gli acquisti sono soggetti alla Politica Resi e Rimborsi 30 Giorni.

Submitting an order constitutes a purchase offer. FAIL Streetwear reserves the right to accept or reject any order at its discretion. The order is considered confirmed only after our acceptance. Customers must verify their information carefully before submission. Purchases are subject to the 30-Day Return and Refund Policy.

4. Prezzi e Fatturazione / Prices and Billing

I prezzi dei prodotti possono variare, ma viene applicato il prezzo valido al momento dell’ordine. Salvo diversa indicazione, i prezzi sono al netto di imposte, costi di spedizione e dazi doganali. FAIL Streetwear può emettere fattura elettronica su richiesta nel rispetto della normativa italiana.

Product prices may change, but the price applicable at the time of the order will prevail. Unless otherwise stated, prices exclude taxes, shipping, and customs duties. FAIL Streetwear can issue an electronic invoice upon request, in accordance with Italian regulations.

5. Spedizione e Consegna / Shipping and Delivery

I tempi di consegna sono indicativi e non vincolanti. Dal momento in cui il pacco viene affidato al corriere, il rischio di smarrimento passa al cliente. I tempi di consegna possono variare in base alla destinazione e al corriere selezionato.

Delivery times are indicative and non-binding. Once the package is handed to the courier, the risk of loss transfers to the customer. Delivery times may vary depending on destination and courier.

6. Proprietà Intellettuale / Intellectual Property

Tutti i contenuti, loghi, testi e immagini presenti sul sito sono di proprietà esclusiva di FAIL Streetwear e protetti dalle leggi sul diritto d’autore e sui marchi. Qualsiasi uso non autorizzato è vietato. I marchi Shopify sono di proprietà dei rispettivi titolari.

All content, logos, texts, and images on the website are the exclusive property of FAIL Streetwear and are protected by copyright and trademark laws. Any unauthorized use is prohibited. Shopify trademarks are owned by their respective holders.

7. Diritto di Recesso e Politica Resi 30 Giorni / Right of Withdrawal and 30-Day Return Policy

I clienti residenti nell’UE hanno diritto di recedere entro 14 giorni dalla consegna, salvo eccezioni (beni personalizzati o sigillati aperti). FAIL Streetwear estende volontariamente questo diritto a 30 giorni. Per richiedere un reso, scrivere a support@failstreetwear.com indicando numero d’ordine e motivo.

EU customers have the right to withdraw from the purchase within 14 days of delivery, except for exceptions (e.g., customized or opened sealed goods). FAIL Streetwear voluntarily extends this right to 30 days. To request a return, email support@failstreetwear.com with your order number and reason.

8. Garanzia Legale di Conformità / Legal Warranty of Conformity

I prodotti sono coperti da garanzia legale di 2 anni per difetti non imputabili a uso improprio. Il cliente ha diritto a riparazione, sostituzione o rimborso.

Products are covered by a 2-year legal warranty for defects not caused by misuse. Customers are entitled to repair, replacement, or refund.

9. Strumenti di Terze Parti / Third-Party Tools

Il sito può includere strumenti gestiti da terze parti. L’utilizzo è a discrezione e responsabilità del cliente, secondo le condizioni dei rispettivi fornitori.

10. Rapporto con Shopify / Relationship with Shopify

Il negozio è ospitato su Shopify. Le vendite avvengono esclusivamente tra il cliente e FAIL Streetwear; Shopify non è parte del contratto di vendita né responsabile di eventuali reclami.

The store is hosted on Shopify. Sales occur solely between the customer and FAIL Streetwear; Shopify is not a party to the sales contract and is not responsible for any claims.

11. Privacy / Privacy

Il trattamento dei dati personali è regolato dalla nostra Informativa sulla Privacy conforme al GDPR. Shopify può trattare dati per finalità tecniche e di sicurezza.

12. Limitazione di Responsabilità / Limitation of Liability

FAIL Streetwear non è responsabile per danni indiretti o consequenziali derivanti dall’uso dei Servizi, nei limiti previsti dalla legge. Nulla in questi Termini limita i diritti inderogabili del consumatore.

FAIL Streetwear is not liable for indirect or consequential damages resulting from the use of the Services, within the limits allowed by law. Nothing in these Terms limits the consumer’s statutory rights.

13. Legge Applicabile e Giurisdizione / Governing Law and Jurisdiction

I presenti Termini sono disciplinati dalla legge italiana. In caso di controversia, il foro competente sarà quello del consumatore o, in mancanza, il Tribunale di Como.

These Terms are governed by Italian law. In the event of a dispute, jurisdiction lies with the consumer’s court or, if not applicable, the Court of Como (Italy).

14. Vendite Internazionali / International Sales

Per ordini verso Regno Unito, Stati Uniti, Svizzera e Australia, tempi, dazi e imposte possono variare. Il cliente è responsabile degli oneri doganali e del rispetto delle leggi locali.

For orders to the UK, USA, Switzerland, and Australia, delivery times, duties, and taxes may vary. Customers are responsible for customs fees and compliance with local laws.
